paper is the result of a Canadian Studies Faculty Research Proposal Grant awarded by the Canadian High Comm ission in Australia. The author thanks two colleagues at Deakin, Professor Philip Clarke, the Head of the School of Law, who allowed the author time aw ay from his usual duties for research purposes, and D r.
